1. Introduction

These Terms and Conditions (“Terms”) govern access to and use of The Kaizen Project (“the Company”, “its”, “it”) website, mobile applications, and related products and services (“Platform”). Any individual or entity (the “User”) accessing or using the Platform shall be deemed to have accepted and agreed to comply with these Terms.
These Terms constitute a binding legal agreement between the User and The Kaizen Project. If the User does not accept these Terms, the User should refrain from using the Platform.

2. Changes to Terms and Platform

The Kaizen Project reserves the right to update or modify these Terms at any time. Updates will be posted on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. The Kaizen Project may modify, suspend, or discontinue any part of the Platform without prior notice.

3. User Accounts and Eligibility

The User must provide accurate and complete information during registration.
Each account is personal and non-transferable. The User is responsible for maintaining the confidentiality of login credentials and for all activities conducted under the User’s account.
Users below the age of majority in their jurisdiction must obtain parental or guardian consent.
The Kaizen Project reserves the right to suspend or terminate any account in the event of a violation or suspicious activity.

4. Platform Usage

The Platform offers career discovery, gamified assessments, personalized AI coaching, skill diagnostics, learning journeys, internships, gigs, and job-matching services.
Use of the Platform is permitted only for personal, non-commercial, educational, and career development purposes.
The User may not copy, modify, distribute, or exploit any content or software from the Platform without express written consent from The Kaizen Project.

5. Payments, Fees, and Refunds

Certain Platform features and services require payment as per current pricing listed on the Platform.All fees are exclusive of applicable taxes.Payments must be made in advance to access paid services.Refunds are subject to The Kaizen Project’s Refund Policy. If dissatisfied, the User may request a refund within [10] days of payment; approval is at The Kaizen Project’s sole discretion.

6. Intellectual Property

All content, trademarks, software, and technology on the Platform are the property of The Kaizen Project or its licensors.No rights or licenses are granted to the User except for personal, limited, revocable use.Unauthorized use of The Kaizen Project’s intellectual property may result in legal action.

7. User Content and Conduct

By posting or uploading content (such as assessments, submissions, feedback), the User grants The Kaizen Project a non-exclusive, worldwide, royalty-free license to use such content for Platform operation and improvement.
The User must not upload or share any content that is unlawful, offensive, abusive, or infringes on the rights of others.
The User is solely responsible for all content and activities conducted under the User’s account.

8. Data Privacy and Security

The Kaizen Project collects and processes personal data as described in its Privacy Policy. By using the Platform, the User consents to such processing.
While The Kaizen Project strives to protect User data, absolute security cannot be guaranteed.

9. Third-Party Content, Links, and Services

The Platform may provide access to or link to third-party content, internships, jobs, and external websites.
The Kaizen Project does not endorse or guarantee third-party content or services and is not responsible for their accuracy, reliability, or security.
Access to third-party services is at the User’s own risk and subject to their respective terms.

10. Disclaimers

Platform content is provided for informational purposes only and does not constitute professional or career advice.
The Kaizen Project does not guarantee the accuracy, completeness, or reliability of any information or any employment outcomes.
The Platform is provided “as is” and “as available,” without warranties of any kind.

11. Limitation of Liability

To the maximum extent permitted by law, The Kaizen Project is not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, profits, or opportunities, arising from the use of or inability to use the Platform.
The Kaizen Project’s total aggregate liability is limited to the amount paid by the User for services in the preceding six months.

12. Indemnification

The User agrees to indemnify and hold harmless The Kaizen Project, its officers, employees, partners, and affiliates from all claims, damages, liabilities, and expenses arising from the User’s breach of these Terms, misuse of the Platform, or violation of any law or third-party rights.

13. Termination

The User may delete the account at any time by contacting The Kaizen Project support.
The Kaizen Project may terminate or suspend access for violation of these Terms or for security, legal, or operational reasons.
Upon termination, the User’s right to access the Platform ceases, and the User’s data will be managed as per The Kaizen Project’s Privacy Policy.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
All disputes are subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.

15. Miscellaneous

If any part of these Terms is held invalid, the remaining provisions remain in effect.
These Terms constitute the entire agreement between the User and The Kaizen Project regarding use of the Platform.
The Kaizen Project may assign its rights and obligations without notice. The User may not transfer rights under these Terms without The Kaizen Project’s written consent.
